1. Acceptance of Terms

Welcome to ai.talentz, a specialized job platform dedicated to connecting talented individuals and organizations within the artificial intelligence sector. By accessing or using our website, services, and tools (collectively, the “Services”), you agree to be bound by these Terms of Service (the “Terms”), which form a legally binding contract between you and ai.talentz. If you do not agree to these Terms, you must not use or access our Services.

These Terms apply to all users of ai.talentz, including job seekers, employers, and any other individuals or entities interacting with our Services. By using ai.talentz, you represent and warrant that you have the full legal capacity to enter into these Terms and to abide by them.

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will endeavor to provide notice of such changes, which may be posted on our website or communicated to you through other means. Your continued use of our Services following any changes to the Terms constitutes your acceptance of those changes.

2. Account Registration and Security

To access and utilize certain features of ai.talentz, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. You agree to immediately notify ai.talentz of any unauthorized use of your account or any other breach of security. ai.talentz will not be liable for any loss or damage arising from your failure to comply with this section.

You may not use the account, username, or password of another member at any time nor disclose your password to any third party or permit any third party to access your account. You also agree not to create multiple accounts or create an account on behalf of someone other than yourself.

ai.talentz reserves the right to terminate your account or your access to our Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users of ai.talentz, or for any other reason at our sole discretion.

3. User Responsibilities

By using ai.talentz, you agree to comply with all applicable laws and regulations and to use the Services only for lawful purposes. You are responsible for all activities conducted under your account and for ensuring that your use of ai.talentz adheres to these Terms of Service.

The following actions are prohibited on ai.talentz:

  • Posting or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable.
  • Engaging in any activity that infringes on the intellectual property rights or other proprietary rights of others.

You also agree not to use the Services to solicit, advertise, or offer to sell any goods or services for any commercial purpose without ai.talentz’s express written consent.

Violations of these User Responsibilities may result in the termination of your account and legal action where necessary. ai.talentz reserves the right, but is not obligated, to monitor and remove any content or accounts that we consider in violation of these Terms.

4. Intellectual Property Rights

All content and services provided on ai.talentz, including but not limited to text, graphics, logos, icons, images, and software, are the property of ai.talentz or its content suppliers and are protected by international intellectual property laws. The compilation of all content on ai.talentz is the exclusive property of ai.talentz and is also protected by international intellectual property laws.

As a user of ai.talentz, you agree to respect the intellectual property rights of ai.talentz and third parties. Except as expressly authorized by ai.talentz, you may not use, copy, modify, distribute, download, display, transmit, or sell any of ai.talentz’s intellectual property without prior written consent from ai.talentz or the respective intellectual property owner.

All rights not expressly granted to you in these Terms of Service are reserved and retained by ai.talentz or its licensors, suppliers, publishers, rights holders, or other content providers.

  • Prohibited Content: You may not post content that infringes on the intellectual property rights of others, contains confidential or sensitive information, or violates the privacy or publicity rights of any third party. Content that is offensive, defamatory, or otherwise objectionable is also prohibited.
  • Content Moderation: ai.talentz reserves the right, but is not obligated, to monitor, edit, or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

7. Limitation of Liability

ai.talentz endeavors to provide a reliable and informative platform for AI-focused job opportunities. However, considering the limitations inherent in digital platforms, the following limitations of liability apply to your use of ai.talentz:

  • Accuracy of Content: While ai.talentz strives to ensure that the information provided on the platform is accurate, we do not guarantee the correctness, reliability, or completeness of any content provided, including job listings and user-generated content.
  • No Endorsement of Listings: ai.talentz does not endorse or recommend any jobs, employers, or candidates featured on the site. The inclusion of any job listing or resume on ai.talentz does not imply approval or endorsement by ai.talentz.
  • No Guarantee of Employment: ai.talentz does not guarantee job placement or employment for users. The decision to hire or to accept a job offer is the sole responsibility of employers and candidates, respectively.
  • Limitation on Damages: To the maximum extent permitted by law, ai.talentz shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the services and content on ai.talentz, even if ai.talentz has been advised of the possibility of such damages.
  • Links to Third-Party Websites: ai.talentz may contain links to external websites or resources. ai.talentz is not responsible for the content, policies, or practices of any third-party sites and does not make any representations regarding their quality, content, or accuracy.

This limitation of liability is a fundamental element of the basis of the bargain between you and ai.talentz and shall apply to all claims of liability (e.g., warranty, tort, negligence, contract, law) and even if ai.talentz has been told of the possibility of any such damage, and even if these remedies fail their essential purpose.

8. Indemnification

You agree to defend, indemnify, and hold harmless ai.talentz, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Service or your use of ai.talentz, including, but not limited to:

  • Your submissions, postings, or other contributions to the site.
  • Any use of ai.talentz’s content, services, and products other than as expressly authorized in these Terms of Service.
  • Your use of any information obtained from ai.talentz.
  • Any violation of the rights of a third party, including but not limited to intellectual property rights, arising from your use of the Services.
  • Any other conduct which, either directly or indirectly, results in legal liability for ai.talentz.

This indemnification obligation will survive the termination of your account and your use of ai.talentz.

9. Modification of Terms

ai.talentz reserves the right, at our sole discretion, to change, modify, add, or remove portions of these Terms of Service at any time. Such modifications shall be effective immediately upon posting the revised terms on ai.talentz. You agree to review these Terms of Service periodically to be aware of such modifications.

Your continued use of ai.talentz after the posting of changes will mean that you accept and agree to the changes. As our user, you are expected to check this page frequently so you are aware of any changes, as they are binding on you.

If any modification is not acceptable to you, your only recourse is to cease using ai.talentz. By continuing to use the services provided by ai.talentz after the date any such changes become effective, you agree to be bound by the revised Terms of Service.

10. Governing Law and Dispute Resolution

These Terms of Service and your use of ai.talentz shall be governed by and construed in accordance with the laws of the jurisdiction in which ai.talentz is headquartered, without giving effect to any principles of conflicts of law.

  • Dispute Resolution: In the event of any dispute, claim, question, or disagreement arising from or relating to these Terms of Service or the breach thereof, the parties shall use their best efforts to settle such disputes. To this effect, they shall consult and negotiate with each other in good faith and, recognizing their mutual interests, attempt to reach a just and equitable solution satisfactory to both parties.
  • Arbitration: If the parties do not reach such solution within a period of 60 days, then, upon notice by either party to the other, all disputes, claims, questions, or differences shall be finally settled by arbitration administered by an arbitration service selected by ai.talentz, in the jurisdiction of ai.talentz’s headquarters.
  • Binding Arbitration: Any arbitration under these terms will be conducted on an individual basis; class arbitrations and class actions are not permitted. You agree that, by entering into these terms, you and ai.talentz are each waiving the right to a trial by jury or to participate in a class action.

This section shall survive any termination of your relationship with ai.talentz.

11. Termination of Use

ai.talentz reserves the right to terminate or suspend your access to our platform and services, with or without notice, for any reason, including but not limited to:

  • Breach of these Terms of Service.
  • Conduct that ai.talentz believes is harmful to other users of ai.talentz or the business operations of ai.talentz.
  • Conduct that violates the rights of ai.talentz or third parties.
  • Inactivity for an extended period.

Upon termination or suspension, your right to use the resources provided by ai.talentz immediately ceases. ai.talentz shall not be liable to you or any third party for any termination of your access to the Services.

You may terminate your account at any time through your account settings or by contacting ai.talentz customer service. Following termination, you will no longer have access to the platform, and we may delete any information associated with your account.

Termination of your account may result in the forfeiture and destruction of all information associated with your account. All provisions of the Terms of Service which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. AI-Specific Conditions

In recognition of the specialized nature of the artificial intelligence sector, ai.talentz incorporates the following AI-specific conditions in these Terms of Service:

  • Data Handling Standards: All parties engaging with ai.talentz must comply with stringent data handling and privacy standards, especially when sensitive AI-related information or proprietary algorithms are involved. Unauthorized sharing or use of such data is strictly prohibited.
  • AI Project Disclosure: Job listings related to AI projects should disclose sufficient information about the nature of the work, including any potential ethical implications or societal impacts, to enable informed decision-making by job seekers.
  • International Compliance: Users who are involved in international AI recruitment or job-seeking must adhere to the legal and regulatory requirements of both the country where the job is located and the home country of the employer or job seeker, as applicable.
  • Innovation and Intellectual Property: Users must respect the intellectual property rights inherent in AI technologies and innovations. Job listings or user profiles that infringe upon, or encourage infringement of, these rights are not permitted.
  • Reporting Misuse: Users are encouraged to report any misuse of ai.talentz in relation to AI-specific activities, including unethical job listings, suspect recruitment practices, or breaches of data handling standards.

By using ai.talentz, you acknowledge the importance of these AI-specific conditions and agree to abide by them. ai.talentz reserves the right to take necessary actions, including account termination, for violations of these conditions.

13. Feedback and Suggestions

ai.talentz welcomes feedback, comments, and suggestions for improvements to the Services (“Feedback”). You can submit Feedback by emailing us, through our contact form, or other communication channels provided by ai.talentz.

  • Use of Feedback: By submitting any Feedback to ai.talentz, you agree that we are free to use, reproduce, modify, and distribute the Feedback for any purpose without any restriction or compensation to you. The Feedback you provide to us will be considered non-confidential and non-proprietary.
  • Ownership of Feedback: You grant ai.talentz a perpetual, irrevocable, non-exclusive, royalty-free, worldwide license to use and exploit the Feedback. This license includes the right to sublicense these rights to any other parties.
  • No Obligation: While we appreciate your feedback and suggestions, you acknowledge that ai.talentz is under no obligation to implement any suggestions or feedback we receive from you or any other user.

Your provision of Feedback is entirely voluntary and will not create any confidentiality obligation for ai.talentz. Furthermore, ai.talentz’s use of the Feedback does not entitle you to any compensation or reimbursement of any kind from ai.talentz under any circumstances.
